Success in judicial review challenging the Parole Board’s refusal of an oral hearing

In the case of R (Ford) v Parole Board of England and Wales [2026] EWHC 131 (Admin), Olivia succeeded in challenging the Parole Board’s refusal of an oral hearing on grounds of procedural unfairness and a breach of Article 5(4) ECHR. Aidan Eardley KC, sitting as a Deputy High Court Judge, found that four factors, including the fact that the Claimant is an IPP prisoner significantly in excess of his tariff, meant that the decision was procedurally unfair and the principles in Osborn had not been properly applied.
