Cancellation Policy
Our Philosophy
We believe in transparency and fairness in our financial dealings. Our cancellation policy is designed to be clear and reasonable, recognising that whilst late cancellation incurs cost for the barrister, we will always act fairly towards our clients.
1. The Brief Fee
Upon acceptance of instructions, a brief fee is payable to cover the barrister’s preparatory work and to secure their availability for the hearing dates. This fee is deemed earned upon acceptance of instructions.
2. Application
This policy applies to all privately-funded cases where a hearing is cancelled, vacated, adjourned, or settled. It applies provided instructions were received at least five (5) clear working days prior to the listed hearing date.
3. Cancellation Fee Structure
The following fees are payable based on the original hearing’s time estimate and the notice period provided to Chambers.
Hearing Length | Notice of Cancellation | Fee Payable |
1 day or less | Within 2 working days of the hearing | 100% of brief fee |
3-5 working days prior to the hearing | 50% of brief fee
2-3 days | Within 4 working days of the hearing | 100% of brief fee |
5-10 working days prior to the hearing | 50% of brief fee
4+ days | Within 10 working days of the hearing | 100% of brief fee |
11-15 working days prior to the hearing | 50% of brief fee |
4. Mitigation (Alternative Work)
In line with our commitment to fairness, we will reduce the cancellation fee if the barrister is able to accept alternative remunerated work during the cancelled period. The fee payable will be reduced by the amount of the fee earned from the alternative work.
5. Discussion & Flexibility
We understand that every case is different. We encourage you to discuss and aspect of this policy, or any specific financial circumstances, with our clerks. We are always willing to consider a fair and reasonable solution.
For any questions or to discuss the application of this policy, please do not hesitate to contact our clerks on 0207 842 7070 or [email protected].
