Migrant Welfare
We advise and represent in the complex area of entitlement to public funds, housing and use of the NHS in the UK, which are restricted for most people under immigration control until they are granted indefinite leave to remain. We advise on the exceptions, such as EU nationals with certain rights, people facing destitution, care-leavers, and those with pending asylum applications.
Barristers in the team advise regularly on the intersection of immigration, housing, community care, and human rights law.
We are instructed regularly to:
- Explain which rights apply for different immigration categories
- Advise on rights to work or to access public funds while a case is under appeal for people who formerly had status but are now facing deportation
- Explain what sorts of assistance count as “public funds”
- Advise on the meaning of “destitution” and whether evidence meets that test
- Advise on individual entitlement to assistance with housing, or to challenge conditions of allocated housing
- Challenge delays in decision making
- Advise on applications to lift a No Recourse to
- Public Funds (NRPF) condition on a visa
- Advise on the Care Act 2014
- Represent in administrative review and judicial review challenges
We are known for our expert, clear and prompt advice.
