Right to Education – Declaration and Damages

In a judicial review claim brought for two profoundly disabled children, the Administrative Court declared on 7 March 2023 that Croydon Council had breached their Rights to Education under Article 2 of Protocol 1 to the European Convention on Human Rights over a period of more than 16 months. The local authority were ordered to pay damages of £10,000 to each child by way of just satisfaction. James Presland appeared for the Claimants, Instructed by TV Edwards.
