R v AF (Croydon Crown Court)

Kitan Ososami’s client was sentenced to 4.5 years’ imprisonment for “honey trap” aggravated burglary and possession of a bladed article in public.

Kitan Ososami represented a woman charged with grievous bodily harm with intent, aggravated burglary, and possession of a bladed article in public.

The Crown’s case was that Kitan’s client acted as a “honey trap” by attending the victim’s home with two other males, who stabbed the victim multiple times. All three stole various items from his property. After an altercation, the two males fled, but Kitan’s client was detained by the victim and subsequently arrested at the scene. Later, in police custody, a concealed knife was found on her person.

On the first day of trial, Kitan’s client pleaded guilty to possession of a bladed article in public. Following the trial, she was unanimously acquitted of grievous bodily harm with intent and its lesser alternative, unlawful wounding. She was convicted of aggravated burglary alongside one of the males, who was also acquitted of grievous bodily harm with intent but convicted of unlawful wounding. The second male has never been identified.

In sentencing, the Judge acceded to Kitan’s submissions that her client’s psychological profile significantly reduced her culpability. He also cited her personal mitigation as a factor in sentencing her to 4.5 years’ imprisonment. The Judge was persuaded by Kitan’s submissions not to impose the mandatory minimum sentence for the knife offence, as exceptional circumstances were present. She received 4 months’ imprisonment for this offence, which will run concurrently.
