Katherine Soroya successful in Upper Tribunal on meaning of “seriously ill” for the purpose of Article 3

Katherine Soroya represented a vulnerable individual with complex mental health problems, successfully demonstrating that they were seriously ill and that their removal from the UK would breach the UK’s obligations under Article 3 ECHR.

Following the SSHD’s appeal, Katherine represented her client in the Upper Tribunal. The SSHD sought to argue that the decision should be overturned as someone who had disengaged from treatment could not be considered “seriously ill”. Katherine successfully defended the decision of first instance which was upheld.

Katherine continues to represent the Appellant.

Katherine was instructed by Elisenda Rubies of Turpin Miller LLP.
