Deportation and Removal

We act in cases where people do not, or no longer, have permission to be in the UK face removal.  We also act where people who have committed a criminal offence, or whose presence in the UK is not considered conducive to the public good, face deportation. We advise those facing deportation, which will be pursued automatically by the Home Secretary for all non-British nationals sentenced to 12 months or more of imprisonment, and can affect even people born in the UK, or who have never set foot in their country of nationality. 

We advise on exceptions to deportation based on factors including family life, and length of residence in the UK, and circumstances in the country to which it is proposed to deport the person. 

We also advise and represent where special deportation rules apply, notably in removal and deportation of those who have rights under European law. These include people with pre-settled or settled status under the EU Settlement Scheme. We also give specialist advice in cases where a person is being stripped of their British nationality and faces deportation as a result (see also the section on “British nationality”).

If a planned removal is imminent, we can be instructed to advise on, and represent in, an urgent application for judicial review,  and to seek an injunction preventing removal.
