Ministry of Justice and Oxleas NHS Foundation Trust settle discrimination claim brought on behalf of a disabled prisoner

Mirren Gidda brought an Equality Act 2010 claim on behalf of a disabled claimant prisoner who had been subject to various incidents of discriminatory treatment while in detention. This included being put in cells that were not suitable for his disabilities and not being provided with lifted access in the prison, forcing the claimant, who is a wheelchair user, to crawl up the stairs.

Mirren, instructed by Jonathan Farrell of Kesar and Co Solicitors, drafted particulars of claim, which prompted the Defendants to make a Part 36 offer to settle. Following advice on quantum from Mirren, the claimant made a counteroffer and the claim settled.
