Re MH (CFC) [2024] HHJ Cox

I represented a 5 year old child in care proceedings where the Guardian criticised the LA and opposed the LA care plan to remove the child from his aunt and Special Guardian with whom he had lived for 3 years. Whilst the Guardian was neutral on threshold there were several serious problems with the way the LA pleaded it and the evidence upon which they sought to rely. In any event the Care Plan was inchoate.

The Judge found the Guardian’s criticisms of the LA were justified. She found that the threshold was not crossed and therefore she had no jurisdiction to make any order.
