R v Steven RICH (aka Steven WHITELAW)

Rebecca Martin succeeded in appealing against a sentence of imprisonment for public protection.

The Applicant received an IPP with a minimum term of 7½ years in 2010 for several armed robberies. He had served long past his tariff expiry date.

The applications for an extension of time and leave to appeal were granted and the appeal was allowed. The Court of Appeal found that the sentencing judge had failed to consider any alternative to an IPP, and that an extended sentence would have sufficed to meet the risk posed by the Applicant.  The Court quashed the IPP and substituted an extended sentence with a custodial term of 15 years and a licence extension of 5 years.
