Margo was instructed by Advocate to advise a Vietnamese teenager who had been trafficked to the UK aged just 11 and taken into foster care. Aged 17 he applied for indefinite or in the alternative 4 years’ leave to remain as a child in care under Annex FM 3.2. The SSHD granted him just 1 year leave to remain, which would leave him in danger of losing the right to work and study and facing removal action once his leave expired and he ceased to be a child in care. Margo was instructed just 2 days before limitation. She was able to advise on merit, find legal aid solicitors to take on the case, and to draft grounds to issue a judicial review of the decision in time. Permission having been granted, the SSHD agreed to settle the matter, granting LT 4 years’ leave to remain.
