Section 204 appeal for vulnerable transgender woman is allowed and the Local Authority’s decision quashed

Olivia succeeded in a Section 204 appeal which raised complex issues concerning jurisdiction. The appeal was allowed on the basis that the Local Authority who accepted the conditions for referral were met, were not involved in the review decision and this amounted to a breach of the Procedures for Referrals of Homeless Applicants to Another Local Authority Guidance.

This was of particular importance for the Appellant because of her considerable mental health issues, and the need to consider mental health service availability in the Local Authority she had been referred to.

The decision was therefore quashed and both Local Authorities were ordered to undertake a fresh decision together.
