Court Of Protection
One Pump Court’s Court of Protection team covers health and welfare, property and affairs, and medical treatment cases, including for the Official Solicitor and other litigation friends acting for protected persons, family members, friends, attorneys and would-be attorneys. We are lucky to have members with long experience of working with and on behalf of persons who lack capacity, young and old.
Members have experience of all aspects of the Mental Capacity Act 2005 and related matters including:
- The Children Act 1989.
- “Best interest” disputes, including about residential arrangements.
- Contact.
- Protected persons going to live outside the UK.
- Unlawful detention/deprivation of liberty cases, including damages cases
- Medical treatment and withheld consent matters, including short-notice appearances in urgent cases.
- Appointment and discharge of deputies (both welfare and property/financial).
- Powers of attorney.
- Cases where persons lack capacity in cases involving other areas of law covered by chambers, such as immigration, housing, other civil matters, crime and family.
