Re MS & DS (CFC) [2022] HHJ Marin
I represented the father in a discharge care orders application. The LA opposed this and sought a Prohibited Steps Order, limiting where he could go, and a s91(14) order that he would need permission to apply to the Court.
- There was a 4-day hearing
- HHJ Marin found that the LA had failed to promote contact between the boys and their father and failed to notify the father about matters. Whilst the Care Orders were not discharged and a limited s91(14) was made, the Court did make a s34 contact order in the father’s favour and it declined to make any PSO.
