Acquittals in public nuisance case with proportionality left to the jury

Sarah-Jane Ewart secured acquittals in a criminal trial in which protestors were charged with public nuisance.

The defence won legal arguments that the question of whether a conviction is a disproportionate interference with the protestors’ rights to freedom of speech and freedom of assembly (under Articles 10 and 11 ECHR) is a question for the jury.

The jury acquitted all of the Defendants of public nuisance.
