Where an application for leave to remain in the United Kingdom as a spouse had been made before the coming into force of new provisions in the Immigration Rules, the secretary of state had erred in relying upon the new provisions in reaching her decision. However, that defect had been cured by a supplementary decision, which had accurately assessed all the relevant issues under the European Convention on Human Rights 1950 Art.8
