An appeal from a fact-finding hearing in which findings were made that a whole paternal family, spanning three generations, had conspired to make false allegations to the police of mental health issues and violence against a child by a mother, thereby wresting control/residence of a child from her. The father appealed based on ostensibly prejudicial remarks made by the Judge at the outset of the case and concerns about bias in the way the case was heard. At appeal, the Court upheld the judgment and found that the remarks amounted to acceptable judicial interventions.
