Margo acted in an appeal against a refusal of leave under Article 8 ECHR. The Appellant’s student visa had been cancelled in 2013 due to an allegation that he had cheated in the TOEIC test. Following evidence and submissions, the tribunal determined that the Appellant had provided an innocent explanation for discrepancies in his test results, and that the original decision to revoke his leave to remain should be withdrawn. The tribunal accordingly found that the Appellant’s private life in the UK outweighed any public interest in his removal.
