Legal Challenges Training Session: Reconsiderations, Appeals and Judicial Reviews

25 Jun 2024

Claire Physsas will be delivering a training session on Legal Challenges for legal representatives and support workers working with victims of trafficking, for the Anti-Trafficking and Labour Exploitation Unit.

The aim of this course is to equip support workers and legal representatives with the practical skills to prepare reconsideration requests of negative reasonable grounds (RG) and conclusive grounds (CG) decisions. You can expect to discuss and explore examples of challenging by judicial review negative decisions involving survivors of trafficking, including:

– Negative RG and CG decisions
– Public Order and Bad Faith Disqualifications under the Nationality and Borders Act 2022, which deny protections and entitlements to survivors of modern slavery
– Refusals of Discretionary Leave to remain for survivors of modern slavery / Permission to Stay for Victims of Trafficking under the Immigration Rules (VTS leave)
– Refusals of support and accommodation.

This will be useful for both legal representatives who work with victims of trafficking, as well as for support workers in providing an overview of judicial review challenges.
