A JR challenge to the lawfulness of detention of an individual who was severely mentally unwell and an application for interim relief on bail. The substantive JR raises important issues relating to the detention of individuals who are mentally unwell, the decision to detain the Claimant in a prison, whether the detention breached the Equality Act and historic discrimination in nationality issues. The interim relief application considered the relevant test when making an application for bail in these situations.
